Hello world. The following was written 7/08/2018.
On June 22, 2018, after a day of 100 degree temperatures, at approximately 8:15 PM PST, we had a branch measuring approximately 2–3 feet in diameter and approximately 30 feet long, break away from the main trunk of the tree crashing down on our vehicles, home, telephone line and the fence surrounding our back yard.
At the time all of this happened I was asked by a brother how all of this is of benefit to us. A week and a half to almost two weeks later we find ourselves in a sort of limbo. We have been dealing with a legal battle for this house for a long time now. Each side has attorneys and we have a court date scheduled towards the end of this year. Due to the current situation and how things are playing out so far we are seeing a number of possibilities happening here.
It took 3 or 4 days for their attorney to respond to our inquiry for the insurance information for this property since it is being carried under the name of the lender. The attorney asked for pictures and a description of the damages and what happened. Both were sent to him within 24 hours. That was on the 29th of June. We have still not heard anything back from them regarding the insurance information, if an assessment of the damages will be done nor any acknowledgment that the appropriate people have been contacted.
Alex and I were talking about how all of this is of benefit to us. What seems to be happening here is this, if we are renters the lack of response to the situation shows a pointed lack of concern and care from the “landlord” about the property and us as tenants. If we are home owners and they are the “lender holding the insurance coverage” then the lack of response to our inquiry for that insurance information to get this situation taken care of shows a pointed breech in the contract on their side with their unwillingness to respond and give us the information needed and that we have asked for. Either way we look at it, it shows them in the worst possible light as a business partner or as a landlord. If they are willing to treat their own family like this, how do they treat their tenants who are complete strangers to them? That is what is going to stand out glaringly to that jury and the judge.
In normal situations such as this when there is an issue that needs to be dealt with and the landlord is not responding, the tenant is allowed to withhold rent until the situation has been resolved. There is a similar thing that can happen with lenders who hold things like insurance policies on the properties(?), I think. There may now be a possibility, due to this lack of response on their part, of forcing this into court sooner due to the damage and possible danger of that tree collapsing more branches that are larger onto the house itself as the heat rises. That this situation has now become dangerous and life threatening not just to us, but the general public that traverses the sidewalk that is under some of the branches of that tree.
The picture that is being painted here of this family member and their business practices and general care and concern for those around them is pretty dark. Their actions or lack of reaction in regards this situation is speaking volumes above and beyond anything we could ever do or say against them. We need do nothing here for they are burying themselves.
These are just a few of the aspects that are being pointed out to us in regards how all of this may be of benefit to us. That the end result may be an emergency court proceeding that hands us this house outright with nothing left owing and because of their insistence that there be a jury trial punitive damages will be awarded as well.
How has all of this been of benefit to us? The possibilities are there and being high lighted beautifully for us right now. All we need do is sit back and watch the show unfold as they bury themselves without anything being said or done by us. They do it all to themselves.
